In a startling legal move, 11-year-old Nelson George, represented by his father Bankole George, has initiated a legal battle against Limi Children’s Hospital Limited.
The N100 million lawsuit, filed on August 28, alleges severe misdiagnosis and mistreatment that resulted in irreversible damage to one of Nelson’s testes.
Nelson, a Grade Level 18, Step 11 Director of Dangote Cement Plc., sought medical attention for his son on January 30, 2023, when the young boy experienced abdominal pains and swelling in his genital and scrotum.
Limi Children’s Hospital, part of Bankole’s National Health Insurance Scheme, conducted tests, diagnosing Epididymo-orchitis/Torsion.
However, Nelson’s health deteriorated, leading to subsequent admissions and treatments for malaria, sepsis, and peptic ulcer disease.
Claiming that the delay in proper diagnosis caused irreparable harm, Nelson has demanded N100 million in damages.
The lawsuit, marked FCT/HC/CV/7356/2023, also seeks an additional N5 million for filing costs. Nelson urges the court to order a written apology from the hospital and involves regulatory bodies, including the Medical and Dental Council of Nigeria and the Federal Competition and Consumer Protection Commission, as defendants.
Raimi Children’s Hospital has denied any wrongdoing, asserting adherence to standard medical protocols.
Despite the hospital’s legal stance and an absolving letter to Nelson’s lawyer, the young boy’s legal representation argues that the hospital neglected its duty to accurately diagnose and treat Nelson’s condition promptly.
Justice Akanbi Yusuf of FCT High Court, Kubwa, has scheduled the hearing for December 20, 2023. The defendants, including the hospital and regulatory bodies, are yet to respond to the legal proceedings.
This lawsuit raises critical questions about medical accountability and the responsibilities of healthcare providers in ensuring accurate diagnoses and timely treatments, especially concerning the well-being of young patients.
