An Ogun State High Court on Friday struck out Certificate forgery case filed against the All Progressives Congress Chairmanship Candidate, Obafemi-Owode Local Government , Hon. Ogunsola Adesina .
Adesina has been dragged to the court asking the court to rule that he is not qualified to be the flag bearer of APC in the forthcoming Local Government Election .
Adesina was accused to have presented a forged result and submitted the fake result to the party screening panel .
While striking out the case , Justice Abiodun Akinyemi struck out the case on the ground that the suit filed within the time pm stipulated by the Constitution.
In his judgement,Akinyemi hinged his decision on the 1999 Constitution as amended, which provides for the time frame within which a preelection matter could be filed.
Akinyemin said the aggrieved person should file the suit within 14 days from the day the event complained about happened.
According to the judge , it was observed by the court that the event complained about happened on the 24th of May, 2021, while the claimant filed on the 28th of June, 2021.
He ruled that the suit was filed outside the time permitted by law: hence renders the action dead on arrival.
He said “from the forgoing, it is obvious that the legal action relied upon by the claimant to truncate the candidacy of Hon Ogunsola, being the flag bearer of Obafemi-Owode local government local government under the platform of APC in the forthcoming election had been silenced by the verdict of the Court.
