Justice Inyang Ekwo of the Federal High Court Abuja has issued a restraining order against the Nigerian Police Force (NPF), preventing them from tendering a DNA test result in the ongoing paternity dispute involving Kabiru Tanimu Turaki, former Minister of Special Duties and Intergovernmental Affairs.
Turaki is embroiled in a legal battle with Hadiza Baffa over paternity claims, with the police intending to present a DNA test allegedly obtained in violation of Turaki’s rights.
The court’s decision came after Turaki’s counsel, Abdulaziz Ibrahim (SAN), raised concerns that the purported DNA test was unlawfully procured and could prejudice his client’s defense.
Earlier, Justice Ekwo had declined Turaki’s plea to block the police from using the DNA test in a separate criminal case pending before an FCT Magistrate Court.
However, upon further review and in response to a subsequent application by Ibrahim, the judge ruled to restrain the police pending a full hearing.
“The respondents are hereby restrained from taking any action that may adversely affect the relief sought by the applicant on the motion ex-parte,” Justice Ekwo declared.
The court also ordered the police and all parties involved to comply with the directives to file necessary affidavits and responses before the next scheduled hearing on February 28.
This directive follows the respondents’ failure to comply with earlier court orders, prompting criticism from the bench over procedural delays.
Turaki, through his legal representative, expressed satisfaction with the court’s intervention, emphasizing the importance of upholding due process and protecting individual rights in legal proceedings.
