The Kano State Government has dismissed concerns that the recent ruling by the Court of Appeal invalidated the reinstatement of Lamido Sanusi as the 16th Emir of Kano, clarifying that the court only granted a temporary stay on its judgment pending an appeal before the Supreme Court.
The appellate court had earlier overturned a Federal High Court decision that nullified the state’s repeal of the 2019 Emirate Council Law, which paved the way for Sanusi’s return as Emir.
However, in its latest ruling on Friday, the court restrained the execution of its January 10 judgment, stating that the status quo should be maintained until the Supreme Court delivers its verdict.
Addressing journalists in Kano, the state’s Attorney General and Commissioner for Justice, Haruna Dederi, stressed that Sanusi remains the Emir of Kano.
“The Court of Appeal did not reverse its judgment. It merely granted a stay of execution pending the outcome of the Supreme Court case. The January 10 ruling that upheld the repeal of the 2019 Emirate Council Law is still valid,” Dederi said.
He emphasized that only the Supreme Court has the authority to overturn the appellate court’s ruling, not the Court of Appeal itself.
The legal battle stems from the Kano State Government’s decision to repeal the 2019 Emirate Council Law, which had divided the Kano Emirate into five and led to Sanusi’s dethronement in 2020.
Following his reinstatement in 2024, some aggrieved parties, including Aminu Baba Dan Agundi, challenged the decision in court.
While the appellate court faulted the Federal High Court’s jurisdiction to hear the case, it agreed to suspend the enforcement of its ruling, allowing the Supreme Court to determine the final outcome.
Despite the legal uncertainty, the Kano State Government insists that its actions remain lawful, reaffirming its commitment to Sanusi’s continued reign as Emir.
