The Court of Appeal sitting in Ibadan has struck out an appeal filed by the Ogun State Government, delivering a major victory to the Gbenga Daniel family in the contentious demolition of Datkem Plaza,.
The plaza located in Ijebu-Ode, a five-story complex owned by Yeye Olufunke Daniel, wife of former Governor and current Senator, Otunba Gbenga Daniel was demolished by agents of the state government on the ground that it violated the building plans of the state .
The ruling, delivered by Hon. Justice Y.B. Nimpar, dismissed the appeal for lack of competence, effectively upholding the lower court’s judgment against Governor Dapo Abiodun’s administration.
The decision further fuels allegations that the demolition, carried out under controversial circumstances, was politically motivated.
PLATFORM TIMES reports that the multi-billion-naira property, valued at approximately N5 billion, was brought down in the dead of night, raising suspicions of sabotage.
It was further gathered that the agents allegedly acting on government orders initially planned to use dynamite to simulate structural failure.
However, to avoid collateral damage, the demolition was ultimately executed with jackhammers and bulldozers under the cover of darkness.
By morning, what was poised to become Ijebu-Ode’s tallest and most prominent commercial hub lay in ruins, sparking outrage among residents and political observers.
Reacting to the development, the State
Government justified the action by citing planning infractions, a claim the Daniel family strongly refuted, presenting evidence of compliance with all regulatory approvals.
Determined to seek justice, Yeye Olufunke Daniel took legal action, arguing that the demolition was illegal, vindictive, and a direct attack on her family.
The lower court ruled in her favour, leading the state government to file an appeal, which has now been struck out by the Court of Appeal.
Legal analysts say the ruling is a significant setback for Governor Abiodun, as it reinforces the argument that the demolition was driven by political vendetta rather than legal justification.
The longstanding rivalry between Abiodun and Senator Daniel, who represents Ogun East in the Senate, has fueled speculation that the destruction of Datkem Plaza was part of a broader political battle.
