The Oyo State High Court in Awe, Oyo State, has dismissed a case brought by the Oyo kingmakers (Oyo Mesi) against Governor Seyi Makinde, the state Attorney General, and the Commissioner for Local Government and Chieftaincy Matters regarding the vacant stool of Alaafin of Oyo due to an administrative defect.
The case arose following the passing of the late Alaafin of Oyo, Oba Lamidi Adeyemi III, who ruled for 52 years.
The claimants, including prominent figures such as Chief Yusuf Layinka and Chief Gbadebo Mufutau, sought an injunction to prevent Governor Makinde from interfering with their choice for the vacant stool.
However, Justice Ladiran Akintola ruled that there was no proof of service to notify the governor of the selection process outcome as conducted by the kingmakers.
Consequently, the case was struck out, as the failure to serve the notice affected its substantive nature.
In response, the lead counsel for the claimants, Kunle Sobaloju (SAN), revealed that a notice of appeal and a motion for injunction pending an appeal have been filed at the Court of Appeal and Oyo High Court, respectively.
Sobaloju clarified that the judgment passed on Tuesday was based on a preliminary objection filed by the defendants, emphasising that the merit of the case is yet to be considered. Despite the setback, the legal battle continues as the claimants pursue further legal avenues.
