Justice Peter Lifu of the High Court of the Federal Capital Territory (FCT) has prevented the Peoples Democratic Party (PDP) from removing its acting national chairman, Ambassador Umar Iliya Damagum, from his position.
The court’s decision came following a motion presented by M. O. Onyilokwu, Esq., representing the Plaintiff/Applicant.
Justice Lifu issued a restraining order against the PDP, preventing it from appointing, selecting, or nominating anyone to replace Ambassador Umar Illiya Damagum as National Chairman or Acting National Chairman of the party until the motion on notice is heard and determined on May 14, 2024.
The court also prohibited the PDP from according recognition to any individual other than Ambassador Umar Illiya Damagum as Acting National Chairman, or from acting upon any documents purportedly signed by the National Chairman or Acting National Chairman without Damagum’s name and signature.
The court also directed the applicants to provide an undertaking to pay damages to the respondents if it is later discovered that the order was wrongly granted or if the court was misled into granting it.
The order stemmed from a motion ex-parte filed by Senator Umar El-Gash Maina and Alh. Zanna Gaddama, identified in the suit marked: FHC/ABJ/CS/579/2024.
The respondents listed in the motion, dated and filed on May 2, 2024, include the PDP, its National Working Committee (NWC), National Executive Committee (NEC), Board of Trustees (BoT), and the Independent National Electoral Commission (INEC).
The plaintiffs sought an interim injunction to prevent the defendants from appointing a replacement for Ambassador Umar Illiya Damagum until the motion on notice is resolved.
The affidavit supporting the application, along with affidavits of extreme urgency and non-multiplicity of action, were all sworn by Ambassador Umar El-Gasha Maina.
