The legal battle over the Kano emirship deepened as Aminu Babba Dan’Agundi, Senior Counsel to the 15th Emir of Kano, Aminu Ado Bayero, announced plans to challenge the recent Court of Appeal judgment in favour of the 16th Emir of Kano, Muhammadu Sanusi II, at the Supreme Court.
Dan’Agundi, who holds the traditional title of Sarkin Dawaki Babba in the Kano Emirate, disclosed the decision during a media briefing at the Nassarawa Mini Palace.
He described the appellate court’s ruling as unsatisfactory, vowing to seek final adjudication at Nigeria’s apex court.
“The emirship crisis has just begun. Nobody can claim victory yet because we are challenging this ruling at the Supreme Court,” he stated.
He explained that legal preparations were underway, adding, “I have already instructed my lawyers to obtain a certified true copy of the judgment.
Once an appeal is lodged at the Supreme Court, the decision of a lower court is stayed until the case is fully resolved.”
The Court of Appeal’s judgment, which sparked the fresh legal maneuver, reportedly suggested transferring the case to the Chief Judge of Kano State for redirection.
Dan’Agundi noted that the court did not dismiss his claims outright but ruled that it lacked jurisdiction to entertain the matter.
He further clarified, “The judge who delivered the lead judgment suggested that the case be redirected for fair hearing.
However, the other two judges disagreed with this view, leading to the appeal being struck out. That is why I am taking this matter to the Supreme Court.”
Dan’Agundi called for calm among Kano residents, urging them to remain law-abiding as the legal proceedings unfold.
“Whatever the Supreme Court decides will be final, and we submit to the will of Allah. Until then, no one should celebrate a victory,” he added.
The emirship tussle has been a contentious issue in Kano, attracting nationwide attention due to its implications for traditional leadership in Nigeria’s most populous northern state.
