Justice Akintayo Aluko of the Federal High Court, Lagos, has issued an interim order restraining the Independent Corrupt Practices and Other Related Offences Commission from arresting or detaining the Vice Chancellor of the Federal University, Oye Ekiti, Prof. Abayomi Fasina.
The court order also prevents the ICPC, its agents, or representatives from taking any further steps in connection with their invitation to Fasina or infringing on his personal liberty and fundamental rights.
This interim measure will remain in place pending the hearing and determination of a Motion on Notice for an interlocutory injunction.
The ruling followed an ex parte motion filed by Fasina in suit number FHC/L/CS/768/2025, presented by his legal team led by Ebun-Olu Adegboruwa (SAN) and O. Adesioye.
The application was supported by an affidavit deposed to by Dr. Adedayo Sobowale, a staff member of FUOYE, alongside documentary exhibits.
Granting the reliefs sought, Justice Aluko ruled, “An interim order is hereby granted directing the respondent, whether by itself, its agents or servants, to maintain the status quo ante bellum with respect to its invitation, threat of arrest, detention or curtailment of the applicant’s personal liberty and fundamental rights, pending the hearing of the Motion on Notice.”
The judge further ordered the ICPC to refrain from taking any additional steps concerning the matter until the substantive motion is heard.
In compliance with the ruling, Prof. Fasina was directed to file a formal undertaking in respect of the court’s order.
The case has been adjourned to April 25, 2025, for the hearing of the Motion on Notice.
Prof. Fasina has been under public scrutiny over allegations of sexual harassment.
While the university senate cleared him of any wrongdoing, internal university unions have continued to push for an independent investigation.
