The Delta State High Court sitting in Orerokpe has restrained the Nigeria Police Force from enforcing the tinted glass permit policy scheduled to take effect on January 2, 2026.
The court, presided over by Justice Joe Egwu, granted an interim injunction on Wednesday following a motion ex parte filed by a private citizen, Mr Israel Joe, against the Inspector-General of Police, the Nigeria Police Force and the Commissioner of Police, Delta State Command.
The suit, marked HOR/FHR/M/31/2025, challenged the planned resumption of the tinted glass permit policy, which the applicant argued could lead to widespread abuse of citizens’ fundamental rights by law enforcement officers.
In granting the application, Justice Egwu restrained the police from “implementing, enforcing or further implementing” the tinted glass permit policy pending the hearing and determination of the substantive motion in the suit.
The court also barred the respondents from stopping, harassing, arresting, detaining or extorting motorists and other citizens under the guise of enforcing the policy.
The judge held that such actions could infringe on constitutionally guaranteed rights, including the dignity of the human person, privacy, freedom of movement and the right to property.
Additionally, the court restrained the police from continuing to use the Parkway Projects account, described in the application as a private account, for any government business pending the determination of the substantive application.
Justice Egwu further granted an order for substituted service on the first and second respondents through the Commissioner of Police, Delta State Command, with service to be effected at the police headquarters in Asaba and deemed proper.
Although the applicant was absent in court, he was represented by a legal team led by Senior Advocate of Nigeria, Kunle Edun, alongside several other counsel.
After hearing submissions from the applicant’s lawyers, the judge granted the motion ex parte as prayed and fixed December 24, 2025, for the hearing of the motion on notice.
The interim orders, which were issued and sealed by the court on December 17, 2025, will remain in force pending the outcome of the substantive application.
