    Court Orders FAAN To Disclose Airport Toll Gate Revenue Since 2015

    A Federal High Court in Lagos has directed the Federal Airports Authority of Nigeria (FAAN) to disclose the revenue generated from toll gates and parking lots fees at all Federal Government-owned airports. 

    The court order extends from January 2015 to January 2024, and the presiding judge, Justice Ibrahim Kala, has given FAAN a three-month timeline to comply.

    The order follows a suit filed by the Registered Trustees of The Centre for Law and Civil Culture, citing FAAN’s failure to respond to a Freedom of Information request made on August 24, 2022. B.O. Fowewe represented the applicant, while A.A. Lawal appeared for FAAN.

    The court, after concluding the hearing on January 25, 2024, and reviewing written addresses from both parties, granted the applicant’s request. 

    Justice Kala declared FAAN’s refusal to provide information as a gross violation of the Freedom of Information Act, 2011.

    In his ruling, Justice Kala stated, “An order of mandamus is hereby granted compelling the respondent to avail the applicant with the details of the statement of accounts showing the total annual generated revenue from the toll gates and parking lots in each of the Federal Government-owned airports across the Federal Republic of Nigeria.”

     FAAN is required to provide evidence of yearly remittances for the specified period within three months from the date of the judgement.
