    Federal High Court Orders Swift, Unconditional Release Of Ex-CBN Governor, Emefiele

    The High Court of Justice in the  Federal Capital Territory (FCT) has issued a compelling order for the immediate and unconditional release of the former Governor of the Central Bank of Nigeria (CBN), Mr. Godwin Emefiele. 

    The court’s decision comes in response to a Motion Ex-parte filed by Emefiele, who sought his release from the custody of the Economic and Financial Crimes Commission (EFCC) while awaiting the determination of the Originating Motion.

    Justice O.A. Adeniyi presided over the case and granted the order after carefully considering the motion presented by Emefiele.

     The respondents in the case, which include the Federal Republic of Nigeria, the Attorney-General of the Federation (AGF), the Executive Chairman of the EFCC, and the EFCC itself, were instructed by the court to comply with its directives.

    The court’s order comprises several key provisions, including Emefiele’s immediate and unconditional release.

     The 3rd and 4th Respondents, representing the Executive Chairman and the EFCC, have been mandated to release Emefiele from detention without any delay.

    Alternatively, they are directed to present him in court on the scheduled date for the hearing of the substantive Motion on Notice. In this event, the court may consider granting bail to Emefiele.

    Furthermore, the court has fixed the date for the hearing of the Substantive Motion on Notice for Monday, November 6, 2023, at 1 pm.

    This hearing will mark a pivotal moment in the legal proceedings, as Emefiele and his legal team present their case, seeking a fair resolution to the matter.

    The court’s decision to order the immediate release of the former CBN Governor and set a hearing date for the substantive motion underscores the importance of upholding due process and the rule of law.

     It will be a closely watched case, as it unfolds in the coming days.
