The legal team representing Nnamdi Kanu, the detained leader of the Indigenous People of Biafra (IPOB), has presented a comprehensive list of judgements to the Attorney General of the Federation (AGF), Lateef Fagbemi.
The submission, made at the Federal Ministry of Justice in Abuja, is aimed at securing Kanu’s release.
Barrister Nnaemeka Ejiofor, leading the legal team, addressed journalists on Thursday, emphasizing that the judgements come from both domestic and international courts, all mandating the release of the IPOB leader.
Ejiofor stated that their decision to forward these legal pronouncements followed a remark by the AGF, suggesting he was unaware of Kanu’s case and that only a competent court could resolve his fate.
Ejiofor urged President Bola Tinubu to adhere to these judgements and facilitate Kanu’s release, respecting the rule of law and judicial directives.
This call to action highlights the ongoing legal and political complexities surrounding Kanu’s detention.
On May 24, AGF Fagbemi acknowledged the complexity of Kanu’s case, noting that it differed significantly from that of Omoyele Sowore, another high-profile detainee. Fagbemi reiterated that Kanu’s case could only be resolved through legal proceedings.
In a related legal development, Kanu’s lawyers recently filed a preliminary objection at the Federal High Court in Abuja.
They requested that Justice Binta Nyako decline jurisdiction over the trial, arguing that the charges against Kanu were unconstitutional.
The legal team contended that the court lacked the authority to try Kanu on counts 1, 2, 4, 5, and 8, which they sought to quash.
Despite these efforts, Justice Nyako dismissed Kanu’s request to restore his revoked bail and denied his transfer from the custody of the Department of State Services (DSS) to house arrest or prison custody.
Kanu has been in DSS custody since June 2021, following his arrest in Kenya, and is facing terrorism-related charges brought by the Federal Government.
