In a pivotal development, the Supreme Court has scheduled the hearing for the Kano State governorship dispute appeal, slated for this Thursday.
Governor Kabir Abba Yusuf of the New Nigeria People’s Party (NNPP) is contesting the decision of the Appeal Court, which affirmed the tribunal’s ruling that unseated him, proclaiming Nasiru Gawuna of the All Progressives Congress (APC) as the victor in the March 11 governorship election.
Barrister Bashir Tudun Waziri, the legal representative for Governor Yusuf, verified that the hearing notice has been officially conveyed to the governor’s legal team.
The crux of the matter lies in the Appeal Court’s assertion that Governor Yusuf was not a registered member of the NNPP at the time of the gubernatorial contest.
This assertion was pivotal in their decision to dismiss his appeal.
However, a twist in the tale emerged when a certified true copy (CTC) of the judgment surfaced, revealing a contradictory order.
In the lead judgment articulated by Justice Moore Adumein, a concluding paragraph on Page 68 stated, “I will conclude by stating that the live issues in this appeal are hereby resolved in favour of the 1st respondent and against the appellant.”
Both the APC and NNPP interpreted the judgment as validation for their electoral triumph.
Notwithstanding, the NNPP promptly filed a notice of appeal before the Supreme Court, challenging the verdict of the Court of Appeal that upheld the decision of the governorship election petition tribunal.
Gboyega Awomolo, SAN, legal counsel for the appellant, outlined 10 grounds for challenging the appeal.
Notably, the appellant contests “the entire judgment of the Court of Appeal, save and except the conclusion and orders at page 67 of the duly certified true copy, CTC, including the order as to cost favorable to the appellant.”
As the legal saga unfolds, all eyes are on the Supreme Court’s impending deliberation, anticipating its impact on the political landscape in Kano State.
