Detained leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, has filed a ₦50 billion lawsuit against the Nigerian Medical Association (NMA) over what he described as a forged and misleading medical report that claimed he was fit to stand trial.
Kanu, who has been in the custody of the Department of State Services (DSS), submitted the fresh suit before the High Court of the Federal Capital Territory (FCT), alleging that the NMA panel failed to examine him as ordered by the Federal High Court.
Justice James Omotosho had, on September 26, directed the NMA president to set up a team of medical experts to independently assess Kanu’s health.
The ruling followed an application from the IPOB leader seeking to be moved from DSS detention to the National Hospital for treatment over alleged deteriorating health conditions, including liver and pancreatic complications, a lump under his armpit, and critically low potassium levels.
However, on October 16, the NMA panel submitted a report in open court stating that Kanu was healthy enough to face trial.
In the new suit filed by his lawyer, Maxwell Opara, Kanu insists that the report was fabricated without any form of medical evaluation, consultation, or interview, contrary to the court’s directive.
“The defendants never visited or examined the claimant. Shockingly, they prepared and submitted a false medical report dated September 23, 2025,” part of the court documents reads.
Kanu listed the NMA, its president Bala Audi, and members of the investigative panel—Benjamin Egbon, Emem Abraham, Ajibare Adeola, Temitope Farombi, Sunday Samson Owolade, Mustaoha Said Salihu, Yarima Suleiman Yusuf, Nwosu Ekeoma and Benjamin Oluwatosin Olowojebutu—as defendants.
He accused the team of professional misconduct, perjury, and reckless disregard for his rights, adding that the alleged false report misled the court into denying him access to adequate medical care and bail, thereby worsening his health and causing emotional and reputational damage.
Kanu is asking the court to: declare the NMA’s conduct a violation of his fundamental rights to fair hearing and human dignity; order the defendants to withdraw and publicly retract the disputed medical report and grant a perpetual injunction stopping the NMA or its agents from issuing any false or unverified medical report about him .
Others include; to compel the association to conduct a fresh, independent medical examination by an entirely different team of specialists ; award ₦50 billion in general damages for health injury, emotional trauma and reputational harm ; and award ₦500 million in exemplary damages for alleged “malicious fabrication”.
The suit comes as Kanu continues his long legal battle over terrorism-related charges filed by the Federal Government, a case that has remained a major flashpoint in the country’s human rights and political discourse.
