The Kano Division of the Court of Appeal has officially scheduled Monday, November 6, 2023, for the hearing of the appeal filed by Governor Abba Kabir Yusuf of Kano State.
This appeal challenges the contentious decision of the State Election Petitions Tribunal, which resulted in the removal of Governor Yusuf from his position as the state governor.
In an announcement made to the press, the appellate court has confirmed that the case bearing number CA/KN/EP/GOV/KAN/34/2023 will be heard on Monday at the Court of Appeal in Abuja.
Parties involved in this high-stakes legal battle encompass Governor Yusuf, representing the New Nigeria Peoples Party (NNPP), the opposition All Progressives Congress (APC), its candidate Nasir Gawuna, and the Independent National Electoral Commission (INEC).
This case follows the Tribunal’s recent ruling that favored the APC, declaring its candidate, Nasir Gawuna, as the legitimate winner of the fiercely contested March 18, 2023 Kano State governorship election.
The Tribunal nullified Governor Yusuf’s election by citing issues with 165,663 of his votes, claiming that the ballot papers lacked INEC’s required signatures and stamps.
It’s worth recalling that INEC initially declared Governor Yusuf the winner of the March 18 election after he secured 1,019,602 votes, in contrast to his opponent Nasir Gawuna, who garnered 890,705 votes.
However, following the Tribunal’s subtraction of the 165,663 votes from Governor Yusuf’s tally, his total was reduced to 853,939 votes, which fell more than 30,000 votes short of Nasir Gawuna’s total.
As a result, the Tribunal declared Nasir Gawuna, the APC candidate, as the victor of the governorship election and instructed INEC to revoke Governor Yusuf’s certificate of return and reissue it to Gawuna of the APC.
Unsatisfied with the Tribunal’s judgment, Governor Yusuf and his political party, the NNPP, along with INEC, have jointly taken their case to the Appeal Court, setting the stage for a pivotal legal confrontation that may ultimately determine the political landscape of Kano State.
The outcome of this appeal hearing is of great significance, with widespread implications for the state’s leadership and the broader Nigerian political sphere.
