The Abuja Appeal Court has explained why it overturned the election of Caleb Mutfwang as Plateau State Governor, citing constitutional breaches and irregularities.
Lead Justice Elfrieda Williams-Dawodu declared the initial tribunal’s judgment affirming Mutfwang’s victory as highly incompetent.
The court emphasized that the tribunal’s dismissal of the APC’s petition was flawed, asserting that the issues raised were both pre-election and post-election matters.
The decision to disqualify Mutfwang under Section 177 of the Constitution stemmed from the PDP’s failure to validly sponsor him, violating a court order mandating a congress in all 17 local government areas.
Critically, the court ruled that the tribunal’s classification of qualification as solely a post-election matter was erroneous, affirming the appellant’s right to contest the validity of the respondent.
Underlining the Electoral Act, the court emphasized the exclusive right of a political party to sponsor a candidate, a right allegedly violated by the PDP.
In a decisive move, invoking Section 136 of the Electoral Act, the court directed INEC to withdraw Mutfwang’s Certificate of Return and promptly issue it to Nentawe Goshwe, the APC candidate.
Justice Okon Abang echoed the sentiment, cautioning the PDP to address internal issues to avoid self-inflicted misfortune in Plateau State.
The ruling sets the stage for a fresh inauguration, reshaping the political landscape in the state.
