In a recent development, the Federal High Court in Abuja has dismissed a suit filed by Hudu Yunusa-Ari, the suspended Resident Electoral Commissioner (REC) in Adamawa.
Yunusa-Ari sought protection against arrest, detention, or prosecution by the police and other authorities.
Justice James Omotosho delivered the judgment, stating that the suit lacked merit.
Despite Yunusa-Ari’s efforts to shield himself from legal actions, the court found no grounds for granting such immunity.
Justice Omotosho agreed with the respondents that Yunusa-Ari’s claims were compromised when he accused them of subjecting him to a media trial.
The judge emphasized that the media’s reporting, being the fourth estate of the realm, must remain free to report newsworthy matters at all times.
The suspended REC had sued the Inspector-General of Police and the Nigeria Police Force, along with other respondents, seeking various reliefs.
These included an order of perpetual injunction against arrest or detention and a demand for an apology for alleged unlawful media trials.
Justice Omotosho clarified that the issue of fair hearing was unrelated to the media’s duty to report, stating, “News reported by the media is not a court of law.”
He noted that the applicant failed to demonstrate being dragged to any court but rather claimed engagement in a media trial.
In conclusion, Justice Omotosho declared the suit “highly unmeritorious” and lacking in merits, leading to its dismissal.
The judgment emphasized that fundamental rights, while significant, are not absolute, and the court will not shield individuals from investigation or prosecution if a prima facie case is established against them.
