A Kano State High Court, on Monday, issued a perpetual injunction restraining the 15th Emir of Kano, Alhaji Aminu Ado-Bayero, and four other dethroned emirs of Rano, Gaya, Bichi, and Karaye from parading themselves as emirs.
The suit, filed by the Attorney General of Kano State, Speaker of the Kano State House of Assembly, and the Kano State House of Assembly, sought to enforce the provisions of the Kano State Emirate (Repeal) Law 2024.
Counsel to the applicants, Ibrahim Isah-Wangida Esq, submitted a motion ex parte on May 27.
The respondents in the suit include Alhaji Aminu Ado-Bayero, Alhaji Nasiru Ado-Bayero (Emir of Bichi), Dr. Ibrahim Abubakar II (Emir of Karaye), Alhaji Kabiru Muhammad-Inuwa (Emir of Rano), and Alhaji Aliyu Ibrahim-Gaya (Emir of Gaya).
Additionally, the suit names the Inspector General of Police, the Director of the State Security Service, the Nigeria Security and Civil Defence Corps, and the Nigeria Army.
The legal team representing Aminu Ado-Bayero had previously withdrawn from the case after the court declined their request to stay proceedings.
Justice Amina Adamu-Aliyu had adjourned the case to July 18 to rule on various applications, including motions for her recusal.
In her ruling on Monday, Justice Adamu-Aliyu upheld the authority of the Kano State House of Assembly to amend and propose legislation for the peace and good governance of the state, as stipulated in section 4 rule 6,7(b) of the 1999 Constitution (as amended).
She clarified that the eviction of the deposed Emir from his Nassarawa palace is a matter for the Rent Tribunal and not within her purview.
Justice Adamu-Aliyu ordered Aminu Ado-Bayero and the four other emirs to cease parading themselves as emirs. She further restrained the Police and other security agencies from violating or tampering with the Kano State Emirate (Repeal) Law 2024.
The deposed emirs were also directed to surrender all properties belonging to the Kano State Emirate Council to the state government.
“The withdrawal of the first respondent’s legal counsel without notice to other parties is unprofessional,” Justice Adamu-Aliyu stated.
She also criticized the actions of the 6th to 9th respondents, who had allegedly smuggled Aminu Ado-Bayero back to Kano, for disregarding their sworn duties to protect lives and property.
Counsel to the applicants, Ibrahim Isa-Wangida, urged the court to dismiss the respondents’ affidavit of facts.
Counsel to Ado-Bayero, Abdul Muhammed SAN, submitted a notice of appeal and a motion to stay proceedings, requesting a halt until the appeal is heard.
Counsel to the 3rd, 4th, and 5th respondents, Hassan Tanko-Kyaure, called for the Kano State Emirate Council (Repeal) Law 2024 to be set aside, arguing that due process was not followed.
He sought the dismissal of the applicants’ case with a cost of N1 billion.
The Counsel to the Inspector General of Police, Sunday Ekwe, had no submissions to make.
The 3rd, 4th, and 5th respondents presented multiple applications, including requests for extensions of time, preliminary objections, and a motion for the judge to recuse herself
