    Delta Guber: Tribunal Admits Evidence Tender By SDP Candidate, Kenneth Gbagi, Adjourns Hearing

    The Governorship Election Petition sitting in Asaba, the Delta State capital, has adjourned the hearing of the case filed by the governorship candidate of the Social Democratic Party (SDP), Olorogun Barr. Kenneth Gbagi, to 19th and 20th July 2023 for the continuation of the hearing.

    This is coming after the tribunal sat on Friday 7th and Saturday 8th of July 2023, to admit all the evidence documents tendered by the lead counsel to Olorogun Gbagi, Mr. Magaji Mato Ibrahim, a renowned Criminologist and Senior Advocate of Nigeria (SAN) on the March 18th, 2023 election.

    The counsel to the SDP gubernatorial candidate argues that the election that brought in the People Democratic Party (PDP) candidate, Sheriff Oborevwori as governor of the state was orchestrated by irregularities, electoral malpractice, and non-compliance with the 2022 Electoral Act, this he argued before the 3-men panel of Justice led by Justice C. H Ahuchaogu.

    But, the counsel to the 1st to 13th Respondents who attempted to object to the evidence tendered by SDP counsel said they would solicit the reason for their objections in their final written addresses.

    Meanwhile, Justice Ahuchaogu ruled after much argument from the counsel that the petitioner, even in a situation where documents are formally acknowledged, would still have to prove or verify the implication of such documents.

    Justice Ahuchaogu told the counsels that in as much they have allowed the documents to be tendered from the bar, their actions indicate that they have given their authorization for the documents to be tendered.

    According to Justice Ahuchaogu, “We grant the application for the counsel to tender such documents.”

    Justice Ahuchaogu also said they have the option to object in their final written addresses as they have rightly said, but adjourned the continuation of the case hearing to the 19th and 20th of July 2023.
