A Shari’a Court sitting at Magajin Gari, Kaduna State, has ordered a man, Tajuddeen Murtala, to vacate his matrimonial home to allow his ex-wife, Hidayat Yusuf, and their six children to continue living there.
The court also directed Murtala to continue taking full responsibility for the welfare and upkeep of the children.
The presiding judge, Malam Mu’awiya Shehu, gave the orders on Tuesday while hearing a custody and maintenance application filed by Yusuf against her former husband.
Yusuf had approached the court, seeking custody of their six children and an order compelling Murtala to provide for their feeding, education, healthcare and clothing.
Through her lawyer, Sadau Garba, she told the court that Murtala issued her a third divorce letter about two weeks ago while she was nursing their 10-month-old baby.
The lawyer said his client currently resides with the six children at Sardauna Crescent, Kaduna, and urged the court to ensure that the children were not subjected to hardship following the dissolution of their parents’ marriage.
Garba specifically asked the court to direct Murtala to continue paying the rent on the apartment occupied by Yusuf and the children.
He also urged the court to order the man to vacate the property, arguing that the former couple were no longer married and that his continued presence could create circumstances capable of leading to an unpleasant incident.
“We pray the court gives Yusuf custody of the children and makes Murtala take responsibility for all their feeding, school, health and clothing,” the counsel told the court.
He further urged the court to compel the defendant to maintain the family’s accommodation arrangements to ensure stability for the children.
After listening to the parties, the judge ordered Murtala to leave the house for his ex-wife and the children while directing him to continue shouldering his parental responsibilities.
The matter was adjourned until November 24 for further hearing.
