A Shari’a Court sitting in Magajin Gari, Kaduna State, on Monday ordered a pregnancy test to determine whether a divorced woman, Khadija Abdurrahman, is pregnant following a dispute with her former husband.
The presiding judge, Malam Mu’awiya Shehu, directed both parties to visit Yusuf Dantsoho General Hospital in Kaduna for the medical examination and ordered them to return to court with the test result on August 11.
The order followed a suit filed by businessman Muhammad Auwal, who asked the court to establish the true pregnancy status of his former wife after receiving conflicting information from her.
Through his counsel, M. Salahuddeen, Auwal told the court that he divorced Abdurrahman in March but had since been receiving calls from her claiming she was pregnant before later informing him that she was not.
According to him, the conflicting claims prompted him to seek the court’s intervention.
“My client divorced the respondent in March. She has been disturbing him with unverified claims of pregnancy. She later called to say she was no longer pregnant,” Salahuddeen told the court.
He added that his client was willing to accept full responsibility if the pregnancy was confirmed.
“If she is truly pregnant, he is ready to take full responsibility. But if she is not, we urge the court to issue a binding order restraining her from disturbing him further,” the lawyer said.
Responding, Abdurrahman denied repeatedly contacting her former husband.
“I only called him once to inform him about the pregnancy. He also disturbs me with calls,” she told the court.
After listening to both parties, Judge Shehu ordered that a pregnancy test be conducted at Yusuf Dantsoho General Hospital to resolve the dispute.
The court adjourned the matter until August 11 for the presentation of the medical report.
The case highlights the role of Shari’a courts in resolving family disputes through judicial processes, including the use of medical evidence where necessary.
