The Supreme Court of Nigeria on Thursday ordered a fresh hearing in the leadership crisis rocking the African Democratic Congress, directing a faction led by former Senate President, David Mark, to return to the Federal High Court.
In a unanimous judgment, a five-member panel of the apex court, led by Mohammed Garba, set aside an earlier directive by the Court of Appeal which had ordered all parties to maintain the status quo pending the determination of the suit.
The apex court held that the appellate court erred in granting the order, effectively nullifying it and clearing the way for the substantive issues surrounding the party’s leadership tussle to be heard and determined at the trial court.
The ruling marks a significant twist in the protracted internal crisis within the ADC, as it reopens legal proceedings that could redefine the party’s leadership structure ahead of future political activities.
Although details of the underlying dispute were not fully disclosed in the brief judgment, the Supreme Court’s decision underscores its position on procedural correctness and the need for lower courts to fully ventilate contentious political matters.
The case is expected to resume at the Federal High Court, where parties will present arguments on the leadership claims and counterclaims that have divided the party.
