In a resolute move to protect telecom subscribers’ privacy, the Nigerian Communications Commission (NCC) has declared its intention to prosecute telemarketers who unlawfully access phone numbers for commercial purposes.
The Nigerian Communications Commission (NCC) has issued a stern warning to telemarketers engaged in the illicit practice of acquiring telephone numbers of telecom subscribers without consent for commercial activities.
In a public notice titled, ‘Unauthorised Use of Telecom Subscribers’ Phone Numbers and Other Personal Information by Telemarketers,’ Professor Umar Danbatta, the Executive Vice Chairman of the NCC, affirmed the commission’s commitment to protecting consumer privacy.
The NCC categorically refuted any claims suggesting that telemarketers obtain telecom consumers’ phone numbers from the commission.
The commission clarified that it strictly adheres to the principles and regulations safeguarding the privacy of telecommunications service consumers.
According to the NCC, no service provider or telemarketer is authorized to collect, harvest, or utilize subscriber data without the explicit approval of the consumer, unless specified by law.
The NCC emphasized the legal foundation for this protection, citing Section 35 (1) of the Consumer Code of Practice Regulations, 2007; Section 9 (1) of the Nigerian Communications (Registration of Communications Subscribers) Regulations, 2022; and Section 4.2 (a) & (b) of the NCC’s Internet Code of Practice.
The commission issued a stern warning to telemarketers involved in the unethical acquisition of telecom subscribers’ phone numbers and personal information for commercial gain without regulatory approval.
It stated that anyone found guilty of this offense would face arrest and prosecution in accordance with the law.
To empower telecom consumers in managing their subscriptions to Value Added Services and combating unsolicited messages, the NCC encouraged them to activate the Do-Not-Disturb (DND) short code introduced by the commission.
This feature allows subscribers to stop unwanted text messages and telemarketing offers by sending “STOP” to the 2442 Short Code for FULL DND.
The NCC further called on telecom consumers to report any instances of illegal activities by telemarketers to the commission through its Toll-Free Number 622.
This reporting mechanism will enable the NCC to take necessary enforcement actions against violators of consumer privacy.
The NCC’s resolute stance reflects its commitment to safeguarding the rights and privacy of Nigerian telecom subscribers while sending a clear message that unlawful practices will not go unpunished.
