The Federal High Court in the Federal Capital Territory, Abuja, has granted leave to a suit seeking to disqualify the appointment of the Minister of Interior, Olubunmi Tunji-Ojo, on the grounds of alleged forgery of his National Youth Service Corps (NYSC) certificate.
Justice Emeka Nwite, in a decision revealed through an order obtained by SaharaReporters on Monday, allowed the case to proceed.
The suit, identified as FHC/ABJ/C5/1155/2023, is between applicant Aare Oladotun Hassan and six respondents, with Minister Tunji-Ojo as the first respondent and the President of Nigeria as the second.
The third to sixth respondents include the Attorney General of the Federation, the Senate President, the Senate, and the National Youth Service Corps (NYSC), respectively.
The court has adjourned the case to the 11th of December, 2023, for a full hearing.
According to the court documents, the applicant seeks several declarations, including the nullification of the purported NYSC certificate presented by the minister and challenging the screening and confirmation processes.
Justice Nwite, in his orders, granted leave to the applicant to apply for judicial review and an order of prohibition against the respondents.
The court also directed the 4th and 5th respondents to present their findings for review and declared that the minister failed to fulfill the conditions precedent under the NYSC Act.
Furthermore, the court declared the presented NYSC certificate as null and void, citing its issuance contrary to the NYSC Act.
The screening and confirmation of the minister were labeled as unlawful, contradicting constitutional provisions.
The court went on to void the certificate purportedly issued by the NYSC and set aside the screening and confirmation. An order of injunction was issued, restraining the respondents from recognizing or giving effect to the minister’s appointment pending the determination of the substantive matter.
